This practice has acted as Employer's Agent in procuring buildings under the JCT Design & Build Form of Contract. We can advise on how to ensure that your new building is truly designed to meet your needs and maximise future capital value.
The advantage of this form of contract is that it allows clients to procure projects with a greater degree of certainty of total cost than is often the case under more traditional forms of contract. Design & Build procurement should transfer the risk of any development to the Contractor, whilst giving the Contractor greater flexibility to deliver the required product.
The involvement of the Employer's Agent can generally be defined as follows:-
Pre Contract Service
- Defining the responsibilities of the Employer, Employer's Agent and Contractor.
- Precisely forming a detailed Employer's brief which identifies and adequately defines specific requirements.
- Assessing the Contractor's proposals to ensure that they comply with all of the Employer's requirements.
- Undertaking the design audit of the contractor's proposals for compliance with the requirements of the Employer.
- Evaluating the offer, the contract sum analysis and stage payments to assess the value for money.
Post Contract Service
- Setting up quality control procedures and reporting on the works carried out on site.
- Providing site visits and chairing meetings.
- Implementing changes to the Employer's requirements as confirmed necessary by the Employer.
- Agreeing stage payments to the Contractor.
- Preparing a monthly project control statement.
- Advising on practical completion and preparing snagging schedules.
